Terms of Service

1. What the Site is

Caroline! I'm Home! is an online marketplace where:

• Buyers publish "Buy Boxes" — public requests describing the property they want to buy (market, budget, property type, purchase structure);
• Sellers, wholesalers, and real estate professionals publish "Deals" — properties they have under contract or for sale;
• The Site matches Buy Boxes with Deals and properties to help the parties find each other.

Buy Boxes are visible to all visitors. When a Professional subscription is offered, access to seller email addresses and messaging with buyers or sellers is available only to users with an active Professional subscription. Buyer email addresses and telephone numbers are not shared with other users, including subscribers; buyers choose whether to share their contact details in a conversation. Buyer telephone numbers are used only by the Site for notifications.

2. We are not a broker and not a party to your deals

• We are not a licensed real estate broker or agent and do not act as one.
• We are not a party to any transaction between users. We do not negotiate, hold escrow, transfer title, or guarantee that any deal will close.
• Nothing on the Site is financial, legal, tax, or real-estate advice.
• You are solely responsible for complying with all federal, state, and local laws that apply to your activity, including laws governing the assignment of purchase contracts, wholesaling, marketing, and advertising of real estate in your state. If your state requires a license for what you do on the Site, obtain it yourself — we do not verify your licensing.

3. Fair housing

You agree not to post any Buy Box, Deal, or message that discriminates against any person or expresses a preference based on race, color, religion, sex, disability, familial status, national origin, or any other characteristic protected under the federal Fair Housing Act or applicable state or local laws. We may remove any content that violates this rule and suspend accounts that repeat violations.

4. Eligibility and accounts

• You must be at least 18 years old.
• The information in your account must be accurate and kept up to date.
• You are responsible for everything done through your account. Do not share your login credentials.
• One account per person or business, unless we approve otherwise.

5. Your content: Buy Boxes and Deals

• You represent that everything you post (Buy Boxes, Deals, photos, descriptions, prices, terms) is accurate and that you have the right to post it — in particular, that, for any Deal you publish, you either hold a contract or ownership interest yourself or have authorization from its holder (for example, under a joint venture (JV) agreement).
• Buy Boxes are public by design. Do not include sensitive personal data in a Buy Box beyond what you are willing to show publicly.
• By posting content you grant us a worldwide, royalty-free license to display, distribute, and promote it on the Site (for example, in search results, emails, and notifications to other users).
• We may edit for formatting, hide, or remove any content that violates these Terms or the law, without prior notice.

6. Verification badges — what they mean

The Site may show badges such as "Verified contact", "Active buyer", or "Confirmed N days ago". These badges reflect information you provided or activity signals we observed (for example, that you reconfirmed your Buy Box). They are not a guarantee of your identity, funds, creditworthiness, or intent to close a transaction. Always verify the other party independently before doing business with them.

7. Matching and results

Matching of Buy Boxes with Deals and properties is provided for information only. We do not guarantee the accuracy, completeness, or availability of any match, property data, price, or contact detail. Property data comes from third-party providers and public sources and may be outdated or incorrect. A match is an introduction, not a recommendation.

8. Professional subscription

We may offer a Professional subscription. It is not available yet; when it is offered, the following applies:

• When offered, an active Professional subscription is required to access seller email addresses, messaging, and certain filters. Buyer email addresses and telephone numbers are not disclosed to other users, including Professional subscribers. Buyer telephone numbers are used only by the Site for notifications.
• Before you enter payment details, we show you right next to the purchase button: the subscription price, the billing frequency (e.g., monthly), the fact that billing recurs automatically until you cancel, and how to cancel.
• By completing the purchase with the subscription checkbox selected (never pre-checked), you give your separate, express consent to recurring billing.
• Fees are in U.S. dollars and are charged in advance on a recurring basis until you cancel.
• Cancel anytime from your account settings in one click — cancelling is as easy as signing up.
• Cancellation stops the next renewal; the subscription remains active until the end of the paid period. We do not provide refunds for partial periods unless required by law.
• We may change subscription prices with advance notice before the change takes effect; the new price applies only from the next renewal after you had a chance to cancel.
• If a payment fails, we may suspend subscription features until the payment succeeds.
• We keep records of your subscription consent as required by law.

9. SMS and mobile communications

We may offer an SMS program. It is not available yet; when it is offered, the following applies. This section describes our SMS program. It exists so that mobile carriers and messaging providers can verify how we handle consent.

• Program purpose. If you provide your mobile number and opt in, we send transactional and informational SMS messages: Buy Box reconfirmation reminders, match notifications, and account/security notices. We do not send marketing SMS without your separate express consent.
• Opt-in. You opt in by checking the SMS consent checkbox (never pre-checked) on our registration or account page, which names BEST MORNING LLC / Caroline! I'm Home!, states the message frequency, and links to these Terms and our Privacy Policy. Consent to receive SMS is not a condition of purchase.
• Frequency. Message frequency varies depending on your activity (typically a few messages per month).
• Cost. Message and data rates may apply.
• Opt-out. Reply STOP to cancel SMS at any time. You may also reply UNSUBSCRIBE, CANCEL, END, or QUIT. We will confirm your opt-out and you will receive no further SMS from that program unless you opt in again.
• Help. Reply HELP for help, or contact info@carolineimhome.com.
• Hours. We send messages between 8:00 AM and 9:00 PM in your local time zone.
• Your mobile information (phone number, opt-in records) is used only to operate this SMS program and is never shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy for details.
• Our messaging complies with the Telephone Consumer Protection Act (TCPA), CTIA messaging principles, and A2P 10DLC carrier requirements.

10. Acceptable use

You agree NOT to:

• post false, misleading, or unlawful content, or content you have no right to post;
• scrape, copy, or resell Site data (including buyer/seller contact details) outside the Site;
• send spam or unsolicited messages through the Site;
• harass, threaten, or impersonate other users;
• upload malware or attempt to disrupt the Site;
• use the Site to discriminate in violation of Section 3;
• circumvent subscription paywalls or share one subscription account among multiple businesses.

By providing your phone number or email and using notification features, you consent to receive transactional messages from us (for example, Buy Box reconfirmation reminders and match notifications) by email or, when SMS is offered, by SMS. Message and data rates may apply. You can manage preferences in your account; some service messages cannot be disabled while your account is active.

11. Messaging between users

Messages you send to other users must relate to genuine real-estate activity. We may monitor messages for safety, fraud prevention, and Terms enforcement. We are not responsible for the content of user-to-user messages or for deals that result from them.

12. Intellectual property

The Site, its design, logos, and software are our property or our licensors' property. You may not copy, modify, or reverse-engineer them except as allowed by law.

13. Termination

We may suspend or terminate your account at any time if you violate these Terms or the law, or for prolonged inactivity. You may request deletion of your account at any time by writing to info@carolineimhome.com; we act on such requests subject to information we must retain by law. Sections 6, 7, 14–17 survive termination.

14. Disclaimers

THE SITE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY BUY BOX, DEAL, MATCH, OR CONTACT WILL LEAD TO A TRANSACTION.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, OR FOR ANY LOSS OF PROFITS OR DEALS, ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM (OR $100 IF YOU PAID NOTHING).

16. Indemnification

You agree to indemnify and hold us harmless from claims arising from your content, your use of the Site, or your violation of these Terms or the law.

17. Governing law and disputes

These Terms are governed by the laws of the State of New York. Any dispute will be resolved in the state or federal courts located in the State of New York, unless otherwise required by law.

18. Changes to these Terms

We may update these Terms from time to time. We will post the new version on this page with a new "Last updated" date. Continued use of the Site after changes means you accept them.
